ESPN reports that the Los Angeles County district attorney's office has referred the airport arrest to the Los Angeles city attorney's office for misdemeanor consideration.

Smith was arrested at the Los Angeles International Airport on April 13 for making a fake bomb threat and eventually he was released on a $20,000 bond.

According to ESPN, the decision for the charges may come within a week and the 49ers have declined to comment on the situation because the case is still pending.

The airport outburst isn't the only time that the pass rusher has found himself in legal trouble as Smith has a court appearance on Tuesday stemming from felony gun charges and a drunken driving charge from Santa Clara County in California.

Due to all of his legal troubles, he may receive discipline from the league.

The 49ers can pick up Smith's option for 2015, however ESPN reported that the team isn't expected to pick up the option before the May 3 deadline due to all of his problems.

Smith, 24, played in 10 games for San Francisco last season recording 34 tackles, 8.5 sacks and a forced fumble and fumble recovery.
