Michael Phelps Instagram Photos: Olympian Over DUI Controversy? Wears a Speedo to Christmas Party [VIDEO]

Michael Phelps doesn't look so powerless, as a judge suggested, at least physically.

The 18-time Olympic gold medal-winning swimmer has set the social media world afire with an Instagram photo he posted of himself a few days ago in a Speedo with a pair of women in matching pajamas and another man in front of a Christmas tree.

"Yep.... I forgot my pjs for the pjs party.... Oops #gfore #aquasphere," Phelps wrote on his Instagram account.

The photo comes just one week after Phelps was in a Baltimore court receiving 18 months of supervised probation for a driving under the influence offense at the end of September. Phelps was ordered to stay away from alcohol during his probation.

The DUI charge was the second against Phelps, the first coming 10 years ago when he was just 19 years old.

Judge Nathan Braverman told Phelps that he was "powerless over alcohol" and suspended a one-year sentence.

"You've made a great start in your road to recovery, but as with your career this is not going to be a success overnight," Braverman told Phelps.

The photo suggests that Phelps is in a better place than he was in September, despite Braverman's admonishment.

The Baltimore Sun reported that the woman standing next to Phelps is Nicole Johnson, a former Miss California. Johnson has been linked romantically with Phelps in the past and multiple outlets reported that the two appear to be a couple again.

Phelps spent 45 days in a rehab facility in Arizona following his Sept. 30 arrest, and still is attending Alcoholics Anonymous and continuing therapy in Maryland, the New York Post's Page Six reported.

If Phelps is powerless over alcohol, his Christmas spirit - not to mention his physique - appears to be unaffected by his recent controversy.
