Hilary Duff and former NHL player Mike Comrie had a good run as a married couple, but they were ultimately unable to make things work out. A few months ago, Duff filed for divorce, and the focus for the couple turned to how they would care for their child.

The couple has a three-year old daughter named Luca. In the initial divorce filings, Duff requested primary custody of the child, although she did say that she would allow Comrie to have visitation rights with the child, according to TMZ.
Comrie has now responded to the divorce filing, and he is asking for joint custody of Luca. Duff is prepared to fight him on the matter, however, as she does not think it is in the child's best interest for the couple to share custody of her.

Duff does not think that Comrie has the necessary responsibility to properly care for Luca because of his penchant for going out and partying.
On the day that Duff actually filed for divorce, Comrie had reportedly been out drinking the night before, and he was reportedly propositioning women in Beverly Hills while he was drunk.
Sorting out the property and financial details should not prove to be too much of an issue since the couple does have a prenuptial agreement, but it sounds like both are prepared to fight for custody of their daughter if that is what it takes.
