San Francisco 49ers linebacker Aldon Smith and Tennessee Titans tight end Delanie Walker have both been sued in connection with an incident where a California man was shot at a party both were attending in the summer of 2012.
According to CSNBayArea.com., both players, than teammates with the 49ers, allegedly fired weapons illegally on several occasions during a June 29 party held at Smith's San Jose home as part of a plan to disperse the crowd where they had charged a $10 entrance fee and sold drinks for $5 each.
In his suit filed in Santa Clara County, Ronndale Esporlas alleges both players had consumed "significant" amounts of alcohol prior to their actions and had even exceeded the legal limit for being intoxicated. In addition, they were illegally carrying the guns they fired.
According to CSN, the police report further states Smith and Walker stood on the balcony of Smith's home and began firing into the the air as a way of ending the party. Walker allegedly fired even more shots after making his way down to the driveway. It's at the point that the plaintiff alleges he was twice struck, causing "serious, catastrophic and permanent injuries" after another group of people also start firing.
Neither Walker nor Smith have been criminally charged in the ongoing probe.
