Proceedings are slated to begin today on whether the judge in the Aaron Hernandez murder case should continue to oversee the case, according to the Hartford Courant.
Earlier this month prosecutors filed a motion seeking to have Superior Court Judge Susan Garsh recuse herself from the case because of her "antagonism and bias" against the prosecution in a prior case.
"In a prior murder case involving the same prosecutor, the judge exhibited antagonism and bias toward the prosecution throughout the case," prosecutors noted in their motion,according to The Courant. "The lead prosecutor and the trial judge currently assigned to this case have a well-known and publicly documented history of antagonism - a history that has, in the past, generated broad public comment and concern."
In addition, William McCauley, who has prosecuted the Hernandez case from the beginning. wrote in an affidavit supporting Garsh's removal that the judge had engaged in bias conduct against the prosecution in the case of George Duarte, a New Bedford man found guilty of murder in the shooting death of a teenager in 2010.
"Her words, tone and behavior were unnecessary, discourteous and demeaning," McCauley actually wrote during the trial. "Counsel for the defendant was not subjected to this same hostile treatment."
Defense attorneys have vehemently objected to the motion. Former New England Patriots tight end Hernandez, 23, remains jailed without bail on first-degree murder charges in connection with the June 17 slaying of semi-pro football player Odin Lloyd. He has pled not guilty to all charges.
