Dwyane Wade Divorce Drama: Siohvaughn Funches Will Not Undergo Psych Tests [VIDEO]

A Miami Appeals Court has ruled Siohvaugn Funches will not be required to undergo a psychological evaluation as her ex-husband Dwyane Wade had requested through his team of attorneys.

According to JocksandStillettos.com, the Third District Court of appeals ruled on Wednesday the mother of the NBA star's two young children will not be required to submit to additional mental evaluation. In addition, the appeals court ruled Antonio Martin, the judge rendering the initial ruling, will now be removed from the case based on his verdict and his denial of Funches "most basic right of due process."

Though they were formally divorced earlier this summer, the two continue to battle over visitation rights with their two young children and the financial terms surrounding their split.

The latest ruling comes at a time when the court-appointed child parenting coordinator assigned to the case recently announced he was washing his hands of the situation. In tendering his resignation, Howard Rosenberg implied the acrimony between the two parties made it impossible for him to "effectively" perform his $400 per hour duties. Though Wade and Funches have been estranged for years, they continue to openly feud over issues ranging from allegations of mental illness, emotional abuse, bad parenting, kidnapping and the hiding of financial assets.

Several media outlets also report Leslie Star, the psychologist directly assigned to evaluate Siohvaughn Funches' mental state, has also resigned in dismay. The website adds Rosenberg has earned about $50,000 coordinating visitations and making sure both parents were were adhering to their court-ordered responsibilities.

In addition to monthly support TMZ has previously reported includes paying her mortgage and for at least two cars she owns, Wade reportedly granted his ex a lump-sum payment of $5 million earlier this summer. Her pending legal request would presumably force him back to the bargaining table.
